Terms and Conditions

These Terms and Conditions apply to the Flying Fit program operated by BASC Enterprises Pty Ltd (ABN 22 636 407 166) trading as Human Performance Collaborative ("Huperco", "we", "us", "our"). 

As of 28th September 2026.

1. INTRODUCTION

1.1 These Terms and Conditions ("Terms") govern access to and use of the Flying Fit program ("Flying Fit") operated by Huperco.

1.2 Flying Fit is delivered in part through a third-party software platform, Lumin ("the Platform"), operated by a separate provider. Your use of the Platform is also subject to Lumin's own terms of use and privacy policy, which apply in addition to these Terms.

1.3 By registering for, purchasing, or accessing any Flying Fit Program, you agree to be bound by these Terms.

1.4 These Terms apply to Flying Fit only. They do not apply to any other program, service, or offering provided by Huperco, BASC Enterprises Pty Ltd, or any related entity.

2. DEFINITIONS

"AIPA" means the Australian & International Pilots Association.

"Clearance" means a current DAME or GP exercise clearance (for an Eligible Pilot, or an Eligible Family Member 18 years or older) or a Parental Clearance (for an Eligible Family Member under 18 years), as described in clause 5.

"Consent Holder" means the parent or guardian who provides Parental Clearance for a minor Eligible Family Member under clause 6, and who is linked to that minor's account in accordance with clause 6.4.

"Eligible Pilot" means an individual who is a current member of AIPA, as confirmed by AIPA to Huperco from time to time.

"Eligible Family Member" means a spouse, partner, or child of an Eligible Pilot, nominated by that Eligible Pilot for access to Flying Fit in accordance with these Terms.

"Parental Clearance" means the written attestation of a parent or guardian described in clause 6.

"Platform" means Lumin, the third-party software platform used to deliver Flying Fit Programs.

"Privacy Policy" means the Flying Fit Privacy Policy referred to in clause 14.6.

"Program" means the specific Foundations, Momentum, or Elevate program (or component of it) made available to you under these Terms.

"Tier" means Foundations, Momentum, or Elevate, being the levels of Flying Fit access described in clause 4.

"you / your" means the Eligible Pilot or Eligible Family Member who registers for or accesses a Program.

3. OUR SERVICES

3.1 Flying Fit's purpose is to increase fitness through exercise. We shape program design that ranges from structured templates a participant selects themselves, through to fully individualised prescription.

3.2 Every Program we build is designed by practitioners with genuinely elite expertise, regardless of Tier. We then support each participant to hold themselves accountable to that Program, with coaching and interaction scaling by Tier to match what each participant chooses.

3.3 Programs are delivered to you through the Platform. Huperco does not operate the Platform - see clause 12.

3.4 Our range of Programs continues to grow and evolve, shaped directly by participant feedback.

4. ELIGIBILITY AND TIERS

4.1 Flying Fit is available to Eligible Pilots and Eligible Family Members only.

4.2 You must be at least 14 years of age to access any Flying Fit Program. Where you are under 18 years of age, clause 6 (Minors) also applies.

4.3 Flying Fit is offered across three Tiers:

(a) Foundations: free of charge to Eligible Pilots, subject to clause 8 (Foundations Participation);

(b) Momentum: a paid Tier delivered in 8-week blocks;

(c) Elevate: a paid, individualised Tier, invoiced on a 4-weekly basis.

4.4 Your eligibility for Flying Fit is linked to the Eligible Pilot's current AIPA membership, which AIPA confirms to us for every registration, including registrations by Eligible Family Members (see clause 14.4). See clause 9 for what happens if AIPA membership ends.

4.5 An Eligible Family Member may register for and access a Program independently of whether the Eligible Pilot holds a Program of their own. See clause 7 for how this affects the fee payable.

5. EXERCISE CLEARANCE

5.1 Before accessing any Flying Fit Program, you must hold, and provide evidence of, a current Clearance.

5.2 For an Eligible Pilot: a current DAME or GP exercise clearance (either is acceptable).

5.3 For an Eligible Family Member 18 years or older: a current GP exercise clearance.

5.4 For an Eligible Family Member under 18 years: a current Parental Clearance, in accordance with clause 6.

5.5 You confirm that your Clearance was issued following an Adult Pre-Exercise Screening System (APSS) assessment, or an equivalent screening process, conducted by the DAME or GP who issued it.

5.6 Huperco's role in relation to Clearance is administrative only. We confirm that a Clearance document exists and is current. We do not assess, interpret, or provide any clinical opinion on the content of any Clearance, and nothing in these Terms should be understood as Huperco providing medical advice (see also clause 10).

5.7 A Clearance has a currency period of 12 months from the date it is issued.

5.8 We will send a reminder approximately 2 months before your Clearance is due to expire.

5.9 You may not commence, purchase, or be invoiced for a new block or invoicing period unless your Clearance is current for the full duration of that period. This is checked before each new period begins, not part-way through one.

5.10 If your Clearance unexpectedly lapses during a period you have already paid for (for example, it is revoked, or a renewal is not completed in time despite the reminder in clause 5.8), your access will be suspended for the remainder of that period.

5.11 Where your access is suspended under clause 5.10, you may request, in writing, either a pro-rata refund or an account credit for the unused portion of that period. We will action either option at your choice - we do not retain payment for access you have not received.

5.12 Access will be reinstated once you provide evidence of a current Clearance, at which point you may enrol in a new period in accordance with clause 5.9.

6. MINORS

6.1 An Eligible Family Member who is under 18 years of age may access Flying Fit only with the written consent of a parent or guardian.

6.2 A parent or guardian consenting on behalf of a minor confirms, to the best of their knowledge, that the minor does not have any medical or physical condition that would make exercise participation inappropriate, and consents to the minor's participation in Flying Fit on that basis (this is the Parental Clearance). This person is the Consent Holder for that minor.

6.3 We will ask the Consent Holder to reconfirm this consent annually, for as long as the minor continues to access Flying Fit.

6.4 A minor requires their own individual account and sign-up — access is not provided as a sub-profile under an Eligible Pilot's or Consent Holder's account. The Consent Holder is linked to the minor's account on the Platform.

6.5 Huperco does not contact a minor directly. All Program communication to a minor is delivered through a group chat function on the Platform, comprising the minor, the Consent Holder, and the minor's coach. This includes our responses to any exercise comments the minor leaves (see clause 11.14).

6.6 Within this group chat, the coach may message the group, and either the minor or the Consent Holder may message the group. Direct one-to-one messaging between the minor and the Consent Holder, or between either of them and the coach individually, is not available through this function.

6.7 The Consent Holder is the parent or guardian who signed the consent form under clause 6.2, regardless of whether they are the Eligible Pilot. Where the Eligible Pilot and the Consent Holder are different people — for example, one parent holds the AIPA membership while the other signs consent for the minor — the Consent Holder, not the Eligible Pilot, is the person linked to the minor's account and included in the group chat under clause 6.5.

6.8 A minor may hold a Momentum Program independently of whether the Eligible Pilot holds a Program of their own. Where the family discount described in clause 7.6 applies to the minor's Program, it is calculated in the same way as for any other Eligible Family Member.

6.9 Date of birth may be provided optionally when a minor's account is created, and is deleted upon archiving of that account.

6.10 Lumin archives a deregistered account and retains its chat history, including any images or video shared in it. Huperco will request a Hard Deletion from Lumin, which permanently removes that chat history, upon client request.

7. FEES AND PAYMENT

7.1 Foundations is provided free of charge to Eligible Pilots.

7.2 Momentum is charged per 8-week block, payable in advance. There is no automatic renewal - a new purchase decision is required for each block.

7.3 Elevate is invoiced on a 4-weekly basis. There is no automatic renewal or ongoing commitment beyond each invoiced period.

7.4 All fees quoted include GST.

7.5 Fees may change from time to time. Any change will apply to new purchases or invoicing periods only, and will not retrospectively affect a period you have already paid for.

7.6 A family discount is available on Momentum for an Eligible Family Member ("the Family Member"), calculated at the time the Family Member purchases a Program. There is no restriction on a Family Member registering for or purchasing a Program at any time, regardless of whether the Eligible Pilot holds a Program of their own.

7.7 The family discount applies where, at the moment the Family Member's purchase is made, the Eligible Pilot holds an active Momentum or Elevate Program invoiced at the standard, non-discounted rate. Where this condition is met, the discounted rate applies for the full duration of the Family Member's Program then being purchased, regardless of any change to the Eligible Pilot's own Program during that time.

7.8 Eligibility for the family discount is assessed independently each time a Family Member purchases a new Program. A Family Member's own current or previous Program, including one purchased at the discounted rate, does not itself qualify another person for the family discount - only an Eligible Pilot's standard-rate Momentum or Elevate Program does.

7.9 If your Momentum Program isn't the right fit, let us know within the first 2 weeks of your block. We will refund the remaining weeks pro-rata, or help you switch to a Program that suits you better, at your choice.

8. FOUNDATIONS PARTICIPATION

8.1 Foundations places are reserved for Eligible Pilots who are actively engaging with their Program.

8.2 If you do not start a Program session for a continuous period of 21 days, your Foundations access will be cancelled.

8.3 We may reach out beforehand to check in and see if we can help - this outreach is a courtesy and is not a precondition to cancellation under clause 8.2.

8.4 You are welcome to reapply for Foundations access at any time.

9. ENDING YOUR ACCESS

9.1 If the Eligible Pilot ceases to be a current AIPA member, Huperco will honour access to any Program already in progress for its remaining scheduled duration, but no further Program may be purchased or commenced.

9.2 As there is no automatic renewal of any paid Tier, no notice is required to end your access - access simply ends at the conclusion of the period you have already paid for, unless you choose to purchase or be invoiced for a further period.

9.3 Huperco may suspend or cancel your access at any time if you breach these Terms, including by providing false or misleading information in connection with a Clearance.

10. HEALTH INFORMATION, WARRANTIES AND NO MEDICAL ADVICE

10.1 Huperco does not interpret, assess, or rely on the clinical content of any medical information. We do not request or collect blood test results, cardiac test results, or other clinical diagnostic information beyond your Clearance document itself.

10.2 We retain your Clearance document as a record that clearance existed and was current at the relevant time. Our role remains administrative: we may read your Clearance document to confirm it is current and relates to you, but we do not interpret or act on its clinical content, and nothing in these Terms should be understood as Huperco making any clinical assessment. See clause 5.6.

10.3 We may collect fitness performance data as part of your Program, such as exercise repetitions, times, or fitness test results (for example, push-up counts or a rowing test), depending on the Program you access.

10.4 Body composition data we collect is limited to BMI and hip:waist ratio. We do not request or collect blood pressure, cholesterol, or other clinical measurements.

10.5 You warrant that any information you provide to Huperco or through the Platform, including in relation to your Clearance and any information described in this clause, is true, accurate, and not misleading.

10.6 Huperco does not provide medical advice. Nothing provided through Flying Fit, including any Program, coaching, or communication, is intended to be, or should be relied upon as, medical advice, diagnosis, or treatment.

10.7 Flying Fit Programs are provided for general fitness and educational purposes. You should consult your DAME, GP, or other qualified medical practitioner before beginning, changing, or continuing any exercise program, and about any specific health concern.

10.8 If, at any time while exercising, you experience chest pain, dizziness, shortness of breath, or any other symptom that concerns you, you should stop immediately and seek appropriate medical attention. In an emergency, call 000.

11. COMMUNICATION AND FAIR USE

11.1 This clause sets out the coaching support and communication provided across each Tier, and the fair use expectations that apply.

Foundations

11.2 Chat and exercise comments are reviewed during the first 2 weeks of your Program, for onboarding support and feedback.

11.3 After week 2, you are welcome to keep using exercise comments as your own training notes; they are not reviewed by us. For any question not answered in our FAQ, email us at flyingfit@huperco.com.au and we will reply within 48 hours.

11.4 Questions about how to use the Platform itself should be directed to our FAQ, not chat, at any stage of your Program.

Momentum

11.5 Chat support is scoped by topic rather than by volume. It is available for questions relating to understanding or executing your current Program, including why your Program is structured as it is, equipment substitutions within your template, and when to progress between phases.

11.6 Chat support does not extend to modifying your Program, injury-specific modifications, adding sessions or goals outside your template, or individual form review requiring your specific history. These fall within Elevate. If you raise them through Momentum chat, we will let you know and point you in the right direction, rather than attempt to answer them there.

11.7 There is no minimum participation requirement for Momentum, and unused access within a paid block does not affect your access.

11.8 Momentum's chat is intended to support your understanding and use of your Program. Questions should relate to your current Program, and we ask that use remains reasonable in frequency. Where a pattern of use falls outside typical program support, we may reach out to discuss.

11.9 A Family Member accessing Momentum, including at the family discount rate under clause 7.6, receives the same chat scope and level of service as any other Momentum client.

Elevate

11.10 Communication with your coach supports the individualised Program agreed at onboarding. Huperco reserves the right to discuss adjusted arrangements with you where usage patterns fall outside what your Program is designed to sustain.

General

11.11 Our quarterly newsletter and any other one-way content we send is separate from, and not governed by, this clause.

11.12 Nothing in this clause affects clause 10 (Health Information, Warranties and No Medical Advice). Coaching provided via chat, messaging, exercise comments, or similar functions remains general in nature, does not constitute clinical or medical advice, and does not involve any assessment or adjustment of your Clearance status.

11.13 Sharing images or video with your coach for technique review is available in Elevate, and in Momentum Youth through the group chat described in clause 6.5, where the Consent Holder can see it. Foundations and Momentum participants are asked not to send images or video.

11.14 Exercise comments are available in every Tier, for questions about a specific exercise in your Program. Where comments are reviewed, we reply within 24 hours, subject to clauses 11.2 and 11.3 for Foundations. For a minor, we respond to exercise comments through the group chat described in clause 6.5, so the Consent Holder sees our response. Health or medical questions are best directed to your DAME or GP (see clause 10.7).

12. THE PLATFORM (LUMIN)

12.1 Flying Fit Programs are delivered to you through Lumin, a software platform operated by a third party.

12.2 Your use of the Platform is subject to Lumin's own terms of use and privacy policy, in addition to these Terms.

12.3 Huperco is not responsible for the technical availability, functionality, or security of the Platform.

13. INTELLECTUAL PROPERTY

13.1 All Program content, materials, and the Flying Fit and Huperco branding remain the property of Huperco (or its licensors) and are protected by copyright. You may not reproduce, distribute, or use this content other than for your own personal use in accordance with these Terms.

13.2 Some Program content may include material from third parties, including publicly available video content embedded from third-party platforms. This material remains the property of its original owner. Huperco does not warrant the accuracy, currency, or continued availability of third-party content.

14. PRIVACY

14.1 We do not interpret or act on the clinical content of any medical information. See clause 10 for what information we collect, and how we treat your Clearance document, in connection with your Program.

14.2 Where your Program involves fitness performance data (such as repetitions, times, or fitness test results) or body composition data (BMI or hip:waist ratio), you are not obliged to provide this information. Choosing not to provide it may affect our ability to program accurately for you, but is not a condition of accessing your Program.

14.3 Program information you provide, including fitness data and Lifestyle Onboarding Quiz responses, is stored under your account on the Platform (Lumin), which holds its data in Sydney, Australia. Your Clearance document is stored separately and is not uploaded to the Platform. The Privacy Policy sets out where each kind of information is held.

14.4 To confirm eligibility for every registration, in every Tier, including registrations by Eligible Family Members and minors, we provide AIPA's membership team with the Eligible Pilot's name and AIPA member number. Where you are an Eligible Family Member, your own name is not shared with AIPA. AIPA will therefore know that a registration has been made in connection with the Eligible Pilot's membership. We do not share your Clearance, quiz responses, fitness data, or Program details with AIPA. Separately, we may provide AIPA with de-identified, aggregate usage data (for example, total participation numbers) to support AIPA's member services. This data will not identify you individually, and will only be shared in a form and at a scale where you cannot reasonably be identified.

14.5 We may invite you to provide feedback on your Program from time to time, to support ongoing improvement. Providing feedback is optional.

14.6 We handle your personal information in accordance with our Privacy Policy, available at www.huperco.com.au.

14.7 By using Flying Fit, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy, including the collection of the health information described in clause 10.

15. LIABILITY AND RISK

15.1 To the maximum extent permitted by law, Huperco excludes all liability for any loss, damage, or injury arising from or in connection with your use of Flying Fit, except where such liability cannot be excluded under the Australian Consumer Law.

15.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified.

15.3 Participation in exercise carries inherent risk. Results vary between individuals, and Huperco does not guarantee any specific outcome.

16. COMPLAINTS

16.1 If you have a complaint about Flying Fit, please contact us at info@huperco.com.au. We will acknowledge your complaint and make reasonable efforts to resolve it promptly and fairly. Complaints about how we handle your personal information are dealt with under the Privacy Policy.

17. CHANGES TO THESE TERMS

17.1 We may update these Terms from time to time. Each version of these Terms shows the date it was last updated, at the top of the document.

17.2 For Foundations and Momentum, because access is not automatically renewed, you will encounter the current version of these Terms each time you commence a new Program or period. Commencing or renewing access after a change constitutes your acceptance of the Terms as they stand at that time. Comparing the version date against your last registration will show you whether the Terms have changed since you last read them.

17.3 For Elevate, where access is intended to continue without a defined end date, we will separately notify you of any change through the Platform.

18. GOVERNING LAW

18.1 These Terms are governed by the laws of Western Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
